Project Review
The prior review of detailed design projects for public works is a legal requirement that ensures the quality, safety and technical compliance of the proposed solutions. In Portugal, this obligation arises from three key legislative instruments:
- Public Contracts Code (Código dos Contratos Públicos, CCP) – Article 43(2) provides that detailed design projects for public works must be subject to an independent review, carried out by an entity other than the author of the project.
- Law no. 31/2009 – Article 18(2) establishes that review is mandatory for works classified as Category III or above, or with a base price falling within Licence Class 3 or higher, and must be undertaken by duly qualified professionals or entities with recognised competence.
- Decree-Law no. 108/2024 – Introduces an exception, waiving the requirement for prior review in projects financed or co-financed by European funds, namely under the Recovery and Resilience Plan (PRR) and other EU programmes.
